Terms of Use

These Terms of Use ("Terms") govern your access to and use of the NIU Nature mobile application ("App") and related services (collectively, the "Service") provided by NIU Nature GmbH ("we," "us," "our"). By using the App, you agree to these Terms.

2. Eligibility and Age Restriction

  • The App is intended for users aged 18 and older.

  • We do not knowingly collect data from children under 18 years of age. If we become aware of such data, it will be deleted immediately.

  • You must have the legal capacity under the laws of your jurisdiction to enter into these Terms.

3. No Medical Advice

  • The App provides informational and educational content only.

  • It is not intended to diagnose, treat, cure, or prevent any medical condition and does not replace professional medical advice.

  • Always seek the advice of a qualified healthcare provider for any medical questions or conditions.

4. Account Creation

  • Some features require creating a user account.

  • You must provide accurate information and keep your login credentials secure.

  • We may suspend or terminate accounts that violate these Terms.

5. Payments and Subscriptions

  • The App offers a freemium model with optional paid subscriptions.

  • Payments and renewals are handled exclusively via Apple App Store (Apple ID account).

  • Automatic Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.

  • Cancellation: You can manage and cancel subscriptions through your Apple ID account settings.

  • Apple’s terms of service govern the purchase and billing process.

6. Refund Policy

  • Refunds for purchases are handled directly by Apple under their policies.

  • We cannot process refunds for subscriptions or purchases made through the App Store.

7. Intellectual Property

  • All intellectual property rights in the App and its content belong to us or our licensors.

  • You may not copy, distribute, or create derivative works without our prior written consent.

8. User Conduct
You agree not to:

  • Use the App for unlawful purposes

  • Attempt to reverse-engineer or disrupt the App

  • Share offensive, harmful, or illegal content

9. Limitation of Liability

  • The App is provided on an "as is" and "as available" basis.

  • To the maximum extent permitted by law, we disclaim all warranties and liability for damages arising from use of the App.

  • Nothing in these Terms excludes liability for gross negligence, willful misconduct, or harm to life, body, or health.

10. Privacy

  • Your personal data is processed in accordance with our Privacy Policy, which includes rights for EU (GDPR) and U.S. (CCPA/CPRA) users.

  • Please review the Privacy Policy to understand how we collect and use your data.

11. Governing Law and Jurisdiction

  • These Terms are governed by the laws of Germany, excluding conflict of law provisions.

  • Mandatory consumer protection laws of your country of residence remain unaffected.

  • Courts in Frankfurt am Main, Germany, shall have jurisdiction for disputes, unless otherwise required by law.

12. Changes to Terms

  • We may modify these Terms to reflect changes in our services or legal requirements.

  • Users will be notified of material changes. Continued use of the App constitutes acceptance of updated Terms.
